In ‘no refusal’ strategy, quick warrants obtained for drivers’ blood

Not only will police be out in force during the New Year’s holidays as part of the national anti drunk driving campaign, but through a “no refusal” strategy law officers are able to quickly obtain warrants from “on call” judges in order to take blood samples from suspected drunken drivers who refuse a breathalyzer test.

According to the National Highway Traffic Safety Administration, a large proportion of motorists pulled over for DUIs refuse a breathalyzer test.

“When it comes to drunk driving we cannot afford to have repeat offenders,” said NHTSA Administrator David Strickland. “The ‘no refusal’ strategy helps support prosecutions and improves deterrence, which means fewer drunk drivers on the road. …”

It’s unlawful to drive with a blood alcohol concentration (BAC) level of .08 or higher but according to NHTSA, in 2009 10,839 persons were killed in alcohol-impaired driving, including 753 last December.
